1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Best Mobile ("Company," "we," "us," or "our") concerning your access to and use of our mobile vehicle repair and maintenance platform (the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Service Description

Best Mobile operates a platform that connects vehicle owners with verified mobile automotive technicians. Our service includes:

  • Admin-managed service request evaluation and cost estimation
  • Matching customers with qualified technicians
  • Secure payment processing for upfront service fees
  • Coordination of mobile repair services at customer locations
  • Communication facilitation between customers, admins, and technicians

Important: Best Mobile acts as a platform connecting customers with independent technicians. We do not directly perform repair services.

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 18 years old to use our Service. By using our Service, you represent and warrant that you meet this age requirement. If you are under 18, you may use our Service only with the involvement and consent of a parent or legal guardian.

3.2 Account Creation

To use certain features of our Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion.

4. Customer Service Terms

4.1 Service Requests

When submitting a service request:

  • Provide accurate and complete information about your vehicle and repair needs
  • Include clear photos or voice notes describing the issue
  • Respond promptly to admin requests for clarification
  • Provide accurate location information for service delivery

4.2 Cost Estimates

Important: Cost estimates provided by our admin team are preliminary assessments based on the information you provide. They are not final quotes. Actual costs may vary based on the technician's in-person evaluation. You will be notified of any changes before work begins.

4.3 Payment Terms

  • Upfront Payment: Payment is required in full before a technician is assigned to your service request
  • Payment Processing: All payments are processed securely through Stripe, our third-party payment processor
  • Payment Authorization: By providing payment information, you authorize us to charge the agreed-upon amount
  • Pricing: All prices are in USD unless otherwise stated

4.4 Service Delivery

  • Technicians will arrive at your specified location during the scheduled time window
  • You must provide access to the vehicle and a safe working environment
  • You or an authorized representative must be present during service
  • Service completion is subject to your approval

4.5 Cancellation Policy

Customer Cancellations:

  • Before technician assignment: Full refund minus processing fee
  • After technician assignment but before arrival: 50% refund
  • After technician arrives: No refund

Service Cancellations by Best Mobile: Full refund if we cancel the service

4.6 Refund Policy

Refunds may be issued in the following circumstances:

  • Service not completed due to technician or platform error
  • Significant discrepancy between estimated and actual service scope (subject to review)
  • Service quality does not meet our standards (subject to investigation)

Refund requests must be submitted within 7 days of service completion. We review all refund requests on a case-by-case basis.

5. Technician Terms

5.1 Technician Application

Technicians who wish to join our platform must:

  • Complete our onboarding process
  • Provide proof of qualifications and certifications
  • Pass background verification checks
  • Complete an interview with our team
  • Maintain appropriate licenses and insurance

5.2 Job Application and Assignment

  • Technicians may apply for jobs that match their skills and availability
  • Admin team assigns jobs based on qualifications, location, and availability
  • Technicians must accept or decline job assignments promptly
  • Accepted jobs must be completed professionally and on schedule

5.3 Service Quality Standards

Technicians are expected to:

  • Perform work in a professional and workmanlike manner
  • Use appropriate tools and genuine or quality parts
  • Complete work within agreed-upon timeframes
  • Maintain clean and safe work environments
  • Communicate professionally with customers and admins

5.4 Technician Payments

  • Technicians are paid securely through our payment system
  • Payment is released after customer approval of completed work
  • Platform fees are deducted from total service cost
  • Technicians are responsible for their own taxes as independent contractors

5.5 Independent Contractor Status

Technicians are independent contractors, not employees of Best Mobile. Technicians are responsible for their own:

  • Tools and equipment
  • Insurance (liability, workers' compensation, etc.)
  • Taxes and tax reporting
  • Licenses and certifications
  • Business expenses

6. Prohibited Uses

You agree not to use our Service to:

  • Violate any applicable laws or regulations
  • Engage in fraudulent or deceptive practices
  • Provide false or misleading information
  • Harass, abuse, or harm other users or technicians
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated systems (bots, scrapers) without permission
  • Circumvent any security features or access controls
  • Upload viruses, malware, or malicious code
  • Collect or harvest user information without consent
  • Use the Service for any illegal or unauthorized purpose

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Service, including all content, features, functionality, software, code, designs, graphics, logos, and trademarks, is owned by Best Mobile and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

7.2 User-Generated Content

When you submit content to our Service (photos, descriptions, reviews, etc.), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display that content for the purpose of providing and improving our Service.

You represent and warrant that you own or have the necessary rights to submit this content.

7.3 Trademarks

"Best Mobile" and our logo are trademarks of our company. You may not use these marks without our prior written consent.

8. Disclaimers and Limitation of Liability

8.1 Service "As-Is"

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 No Warranty on Repair Quality

While we verify technician qualifications, we do not guarantee the quality or outcome of repair work performed by independent technicians. Any warranties on repair work are provided by the technician, not by Best Mobile.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEST MOBILE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or malicious code transmitted through the Service
  • Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content
  • The conduct or content of any third party on the Service

8.4 Maximum Liability

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Best Mobile, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Service
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

10. Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

10.2 Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration before one arbitrator.

The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction.

10.3 Class Action Waiver

YOU AND BEST MOBILE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

10.4 Exceptions

Either party may bring a lawsuit in court to seek injunctive or equitable relief for intellectual property infringement or to enforce arbitration awards.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website with a new "Last Updated" date
  • Sending an email notification to your registered email address (for significant changes)

Your continued use of the Service after changes to these Terms constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms
  • Request by law enforcement or government agencies
  • Fraudulent, harassing, or illegal activity
  • Prolonged inactivity
  • Technical or security issues

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, indemnity, and limitations of liability.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, shall constitute the entire agreement between you and Best Mobile concerning the Service.

15. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by Best Mobile.
